Frequently Asked Questions

In most uncontested cases, a divorce in Ontario takes about four to six months from the date the application is filed, depending on court processing times. Contested matters can take longer because of extra steps such as conferences, disclosure and hearings.

While it is not a legal requirement, having a lawyer review or draft your separation agreement helps make sure the terms are fair, enforceable and that both parties fully understand their rights before signing.

Prenuptial agreements (marriage contracts) are generally enforceable when both parties give full financial disclosure, receive independent legal advice, and sign freely and voluntarily. Courts may set aside agreements that are unfair, incomplete or improperly executed.

ILA makes sure a party understands the terms, rights and obligations in a family law agreement before signing it. The lawyer giving ILA confirms the agreement was entered into voluntarily and provides a certificate that strengthens its enforceability.

Child support is worked out using the Federal Child Support Guidelines, based on the paying parent's income and the number of children. Extra expenses, called section 7 expenses, may also be shared between the parents.
